Dispatch Procedures
1. OUT OF WORK LIST a. The Union will maintain an “Out-of-Work List” or “Book”, which will list the registrants within each group in chronological order of the dates they register their availability for employment. Initial registration on the Out-of-Work List must be done in person at the Union’s office at 3921 N Sillect, Bakersfield, CA from 1:00pm-5:00pm, Monday through Friday, excluding holidays. Subsequent registrations may be done in person as outlined above, or online at kernsolarjobs.com through the webbased application Unionworx. b. When two or more registrations are received in the same day, a lottery will be used to determine the position of each such registrant on the Out-of-Work List. Registrations received online after hours will be included in the roll for the next business day. c. Registrants will be placed in the highest priority group for which they qualify: Group I Previously dispatched registrants who are residents of the geographical area constituting the normal construction labor market (as defined in CBA) that do not have priority status in another IBEW Local. Group II All other previously dispatched registrants. Group III* All other registrants. *Registration for Group III will be done by appointment only and can be suspended at any time. 2. JOB ANNOUNCEMENTS a. All jobs available for referral on the following business day will be listed online at kernsolarjobs.com through the web-based application Unionworx and on the solar job recorder at (661) 384-7570. Postings will be available each workday after 5:00 pm. 3. DAILY DISPATCH a. Registrants must sign the “Daybook” (Bid on Calls) to be eligible for the daily dispatch. b. The “Daybook” may be signed (bid) online at kernsolarjobs.com, through the web-based application Unionworx, or telephonically at (661) 384-7570. Sign-ins (bids) must be received between the hours of 5:00pm on the day the job was posted and 8:00am on the day the job is to be dispatched. All other signins (bids) will not be accepted. c. Daily dispatch will be administered remotely through the web-based application Unionworx. Failure to promptly respond will be treated as a refusal. d. Registrants will lose their place on the Out-of-Work List if they accept a call and do not show up for dispatch or are dispatched to a job and fail to meet the safety/ I-9 requirements of the employer. e. Registrants quitting a job with a signatory contractor may not be eligible to sign the Out-of-Work List for a minimum of 15 calendar days. f. Registrants will not lose their place on the Out-of-Work List if they are rejected by the Employer. g. Registrants who receive a lay-off by no fault of their own within 15 (fifteen) calendar days from their initial report date shall be returned to their appropriate place on the Book. h. Registrations dormant for any 12 (twelve) consecutive month period will be removed from the Book and will require re-registration. Effective 11/01/22 2 4. CALL OUT PROCEDURE a. An employer may request a registrant or group of registrants by name, location of residence (i.e. County, City, Zip Code), previous experience (i.e. CW2P), or special certification/skill (i.e. forklift operation) under the following conditions: i. The Business Manager will refer such registrant(s) to the employer provided that the requested individual(s) is registered on the highest priority group. ii. The requested registrant(s) must have been signed on the out-of-work list for a minimum of 1 (one) week prior to dispatch. b. An employer may request that up to 20% of each manpower request be filled from registrants enrolled in a mutually-agreed upon community outreach program (e.g. veterans’ associations, job training programs), regardless of group priority. c. In an effort to maintain equity within the industry, the Business Manager shall have the right to refuse or limit requests made pursuant to 4.a or 4.b, and may revoke the Call Out Procedure at any time. 5. DISCHARGE FOR CAUSE a. Any individual receiving 2 (two) discharges for cause within a 12 (twelve) month period shall be suspended from future referral from this Local until they appear before the Referral Appeals Committee for a determination as to their continued eligibility for referral. b. Requests to appear before the Referral Appeals Committee shall be submitted to the Local Union Office in writing by the individual being suspended. c. The Referral Appeals Committee shall be composed of 1 (one) member appointed by the Union, 1 (one) member appointed by NECA, and a Public Member appointed by the parties. d. The Referral Appeals Committee shall have the power to make a final and binding decision on any such complaint, which shall be complied with by the Local Union. ANY PERSON SIGNING THE OUT-OF-WORK LIST OR ACCEPTING A REFERRAL FOR EMPLOYMENT IS STATING THEY ARE NOT CURRENTLY EMPLOYED IN THE ELECTRICAL CONSTRUCTION FIELD AND AGREES TO BE BOUND BY THE PROVISIONS OF THESE DISPATCH PROCEDURES. THE BUSINESS MANAGER RESERVES THE RIGHT TO AMEND OR MODIFY THESE PRECEDURES AS NEEDED AND POSTING OF SUCH AMMENDMENTS OR MODIFICATIONS AT THE UNION OFFICE WILL SERVE AS NOTIFICATION TO THE MEMBERSHIP OF THOSE CHANGES MADE.
